Dual Homicide Plea Entry, Child Sexual Assault Hearing Postponed
A 40-year-old Crescent City man accused of killing his parents will wait at least a week to enter a plea in the case.
Though Casey Rhyn Potter appeared before Judge Robert Cochran on Thursday, his attorney, Keith Morris, asked for another week to review evidence before his client enters a plea. Potter is also expected to attend a bail review hearing on March 5, according to Cochran.
Potter is charged with two counts of murder with special allegations of using a fire arm in connection with the deaths of his parents, 77-year-old Brian Gilbert Potter and 71-year-old Sherrie Lynn Potter, both of Crescent City. The couple’s bodies were discovered at their Lesina Road home north of Crescent City on Feb. 16.
Meanwhile, though they appeared before Cochran on Thursday, a severance hearing and the scheduling of a preliminary hearing was also postponed in the case of two Del Norte Unified School District, a Pelican Bay State Prison inmate and a 48-year-old Klamath man who face multiple counts of sexual abuse against a child.
According to Deputy District Attorney Todd Zocchi, Jim Fallman, who is defending Jody Allen Nole, 49, is asking the judge to try his client’s case separately from the case against his wife, 43-year-old Katlin Janice Marie Nole, Kathleen Mary Fuson, 60, and Edward Bert Steele.
Jody Allen Nole, who is serving time at Pelican Bay State Prison, faces seven charges, including sexual intercourse or sodomy with a child 10 years old or younger, continuous sexual abuse and aggravated sexual assault of a child.
Katlin Nole, an instructional aide at Pine Grove Elementary School, is named alongside her husband in three counts of sexual intercourse or sodomy with a child 10 years old or younger, aggravated sexual assault of a child and continuous sexual abuse of a child.
Fuson, a second-grade teacher at Pine Grove, is charged, alongside the Noles, with continuous sexual abuse of a child.
Steele faces charges of aggravated sexual assault of a child.
According to visiting judge Leonard Lacasse, who presided over the suspects’ first court appearance in January, the victim in the case was born in 2006.
According to the court complaint, the alleged crimes took place in Humboldt and Del Norte counties between Jan. 1, 2011 and Dec. 31, 2017.
