Randy Waltz Arraignment Rescheduled After Both Del Norte Judges Recuse Themselves

An arraignment for former appointed sheriff Randy Waltz, who was charged with perjury, voter fraud and election fraud earlier this month, has been rescheduled to May 3.
Both Del Norte County judges disqualified themselves, District Attorney Katherine Micks told the Wild Rivers Outpost on Tuesday — the date initially set for Waltz’s arraignment.
Micks couldn’t say why judges Darren McElfresh and Bob Cochran felt they couldn’t hear Waltz’s case. However, a judicial assistant told the Outpost that anytime there’s a conflict, the judges will recuse themselves.
It will be up to the California Judicial Council to appoint another judge to hear the case, according to the judicial assistant.
Micks formally charged Waltz with perjury, voter fraud and election fraud on March 9, stating in her complaint that Waltz had listed a false address — 16855 U.S. 101 N #2 in Smith River — on his California Voter Registration Form.
According to Micks, Waltz used that address — which belonged to a vacation rental, according to the Sacramento Bee — when he submitted nomination papers or declared his candidacy to run for sheriff on Feb. 14.
Though he took out papers to run for office, Waltz did not submit that paperwork to the Del Norte County Elections Office, tacitly bowing out of the sheriff’s race. He officially resigned as sheriff on March 14, stating that defending himself against the DA’s charges would detract from his ability to perform his duties.
Del Norte County Sheriff’s operations lieutenant Daniel Schneck has taken on the sheriff’s administrative duties until the Del Norte County Board of Supervisors either appoints someone or the sole candidate in the sheriff’s race, retired Crescent City Police lieutenant Garrett Scott, is elected on June 7.
County supervisors have discussed the possibility of appointing Scott as sheriff before the election.
