Del Norte Supes to Discuss How to Fill District 5 Vacancy

County supervisors on Tuesday will discuss options for filling the vacancy left by their colleague, Bob Berkowitz, who died on March 2.

Supervisors on Tuesday will consider a resolution setting an election for the District 5 seat for the Nov. 8 general election.

However, since the governor may appoint someone to fill the vacancy through the next scheduled election, under Government Code Section 25060, the District 5 seat could go before voters in June, County Clerk-Recorder Alissia Northrup said Monday.

The filing period for that seat would open up on Tuesday, as soon as the Board of Supervisors approved the resolution, Northrup said. It depends on what the Board of Supervisors wants to do, she said.

“It would be open for a week,” Northrup told the Outpost, referring to the filing period. “Because the incumbent’s not filing, the filing period would be through the 16th — depending on what the Board opts to do tomorrow.”

Even if the Board of Supervisors takes no action on Tuesday, the governor would still likely appoint someone to replace Berkowitz, Northrup said. She noted that even if the District 5 seat is on the June ballot, if multiple people run and no one wins by 50-percent-plus-one, a runoff election would still be necessary in November.

Northrup said waiting until the general election in November can also be confusing.

“What if you get five people running at the general election, does the highest vote-getter take everything?” She asked.

The Board of Supervisors meets at 10 a.m. Tuesday at the Flynn Center, 981 H Street in Eureka. The public can also participate via Zoom.
